The Jiangsu Provincial People's Court and the Jiangsu Provincial People's Procuratorate jointly issued the "Minutes of the Symposium on Strengthening the Collaboration of Compliance Work among Enterprises Involved in Cases", aiming to further standardize the handling of compliance cases by enterprises involved, provide more enterprises that have committed minor faults with opportunities to reform, and prevent the destruction of a business by handling a case.
According to the "Minutes", Jiangsu will include the compliance status of enterprises as sentencing circumstances in the court trial, and qualified enterprise compliance rectification can be included as discretionary leniency circumstances in sentencing proposals and judgment documents. The minutes also innovatively proposed that enterprises that have passed compliance rectification shall not be prosecuted or shall be exempted from criminal punishment in accordance with the law. For enterprises and individuals sentenced to probation, the People's Procuratorate and the People's Court can explore strengthening the mid-term and long-term effectiveness of enterprise compliance rectification through third-party supervision and evaluation mechanisms, aiming to promote the healthy development of enterprises and entrepreneurs through case handling.
